These Terms of Service apply to your use of the My Red Thread Tales website and to purchases made through our online store.
By accessing our website, placing an order, submitting personalisation information or otherwise using our services, you agree to these Terms of Service.
In these Terms, “we”, “us” and “our” refer to My Red Thread Tales.
1. About My Red Thread Tales
My Red Thread Tales is a New Zealand-based business creating personalised keepsake books.
Our products are individually created using information, photographs, messages and selections supplied by you.
Our online store is powered by Shopify.
2. Eligibility to Order
Our website and ordering process are intended for adults.
By placing an order, you confirm that you are legally able to enter into a contract with us and that the information you provide is accurate.
Where you provide information, photographs or content relating to a child or another person, you confirm that you have an appropriate basis or permission to provide and use that content for the purpose of creating your personalised book.
3. Product Information
We do our best to describe and display our products accurately.
Because each My Red Thread Tales book is personalised, the finished product will vary depending on the photographs, wording, selections and other information supplied by you.
Colours and images displayed on a screen may also vary slightly from the final printed product due to differences in devices, screen settings, image quality, materials and printing processes.
Minor variations of this kind are not necessarily considered defects.
4. Placing an Order
When you place an order through our website, you are making an offer to purchase the selected product subject to these Terms.
An order is not complete until payment has been successfully processed and we have accepted the order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:

payment cannot be processed;
-
pricing or product information contains an obvious error;
-
we are unable to produce the requested product;
-
content supplied is unlawful, harmful or inappropriate; or
-
accepting the order would breach these Terms or applicable law.
If we cancel an order after payment has been received and the cancellation is not due to your breach of these Terms, we will provide an appropriate refund.
5. Personalisation Information
After ordering, you will be asked to provide the information required to create your personalised book.
This may include:

names;
-
photographs;
-
family relationships;
-
personal messages;
-
memories;
-
content selections; and
-
other information relevant to your chosen book.
You are responsible for ensuring that the information you submit is accurate and that you have permission to provide the photographs and other content supplied to us.
Please check spelling, names, dates and personal messages carefully before submitting your form.
6. Creating Your Book
Once we receive your completed personalisation information, we will begin creating your book.
Your digital flipbook proof will usually be prepared within 2–4 working days.
If information is missing, unclear or incomplete, this timeframe may be extended until we receive everything needed to complete your book.
7. Your Digital Proof
Before your book is printed, we will send you a digital flipbook proof.
The proof gives you the opportunity to review the completed book and request reasonable changes before it is submitted for production.
You should carefully review:

names and spelling;
-
photographs;
-
personal messages;
-
selected content;
-
relationships and personal details; and
-
the overall content and layout.
If you identify an error or would like a reasonable change, please let us know before approving the proof.
8. Approval
By approving your digital proof, you confirm that:
-
you have reviewed the book;
-
the photographs and personalised content are correct;
-
you are satisfied with the content and layout shown; and
-
you authorise us to submit the book for printing and production.
Once your approved book has been submitted for production, changes may no longer be possible.
Where possible, we may assist with an urgent request received before printing has started, but we cannot guarantee that changes can be made after approval.
9. Customer-Supplied Content
You retain ownership of photographs, messages and other original content you supply to us.
By submitting that content, you grant My Red Thread Tales permission to use, reproduce, format, crop, resize and otherwise process the content as reasonably necessary to create, proof, print, deliver and support your personalised product.
This permission is limited to purposes connected with your order and our services.
We will not use your private family photographs, personalised messages or completed book for advertising, social media or promotional purposes without your permission.

10. Rights to Photographs and Content
You are responsible for ensuring that you have the right to use all photographs, written material and other content you provide.
You must not knowingly submit content that:

infringes another person's copyright or intellectual property rights;

breaches another person's privacy;
-
is unlawful;
-
is abusive, threatening or discriminatory;
-
contains illegal material; or
-
would be inappropriate for us to reproduce.
We may decline to use content where we reasonably believe it creates a legal, safety or rights issue.
11. My Red Thread Tales Content
Unless otherwise stated, the design, written content, illustrations, layouts, branding, website content, templates and other original materials created by My Red Thread Tales remain the intellectual property of My Red Thread Tales or our licensors.
Purchasing a personalised book does not transfer ownership of our underlying designs, templates, written works, systems or branding.
You may use your purchased book for personal purposes.
You may not reproduce, resell, copy, commercially distribute or create derivative commercial products from our designs or content without our written permission.
12. Pricing and Payment
Prices shown on our website are displayed in New Zealand dollars unless otherwise stated.
Any applicable shipping charges will be shown at checkout.
We reserve the right to change product prices at any time, but changes will not affect an order that has already been accepted and paid for unless required to correct an obvious pricing error.
Payment must be made using one of the payment methods available at checkout.
13. Gift Cards, Discounts and Promotional Codes
From time to time, we may offer gift cards, discount codes, vouchers or promotional offers.
These may be subject to additional conditions shown at the time of issue.
Unless otherwise stated:
-
promotional codes cannot be exchanged for cash;
-
only one promotional code may be used per order;
-
promotional offers may have expiry dates or usage limits; and
-
we may withdraw or correct a promotion where there has been an obvious error or misuse.
14. Production and Delivery
Once you approve your digital proof, please allow approximately 12–20 working days for printing, binding and delivery within New Zealand.
These are estimated timeframes rather than guaranteed delivery dates.

15. Cancellations, Returns and Refunds
Because our books are personalised and individually produced, cancellations, returns and refunds are handled differently from standard retail products.
Once a book has been approved and submitted for printing, it cannot usually be cancelled or returned for change of mind.
Where there is a printing, binding, delivery or preparation issue, we will work with you to provide an appropriate remedy.

Nothing in these Terms limits any rights available to you under New Zealand consumer law.
16. Errors Made by the Customer
If the final printed book matches the proof you approved, we cannot usually provide a free replacement or refund for:
-
incorrect spelling or information supplied by you;
-
a photograph you later wish you had changed;
-
a message or selection you later wish you had chosen differently; or
-
other personalised content that was shown in the approved proof.
However, we encourage you to contact us if something has gone wrong.
Where possible, we will try to find a fair solution and may be able to arrange a corrected replacement at a reduced cost.
17. Errors Made by My Red Thread Tales
If the printed product does not match the approved proof because of an error made by My Red Thread Tales, we will work with you to put it right.
Depending on the circumstances, this may include correction and replacement of the product or another appropriate remedy.
18. Website Use
You may use our website for lawful personal shopping and informational purposes.
You must not:
-
interfere with the operation or security of the website;

attempt to gain unauthorised access to our systems;
-
use automated tools to scrape or copy substantial parts of our website;
-
reproduce or commercially exploit our website content without permission;
-
submit false or misleading information; or
-
use our website for unlawful purposes.
We may restrict access to our website where reasonably necessary to protect our systems, customers or business.
19. Third-Party Services
Our website and services rely on third-party providers, including Shopify, payment providers, cloud services, printing and fulfilment providers and delivery services.
We are not responsible for independent third-party websites or services that you choose to access outside our website.
However, where a third-party provider is involved in fulfilling your My Red Thread Tales order, we remain your point of contact for issues relating to that order.
20. Website Availability
We aim to keep our website and online services available and accurate, but we cannot guarantee uninterrupted access.
The website may occasionally be unavailable due to maintenance, technical issues, service provider outages or circumstances outside our control.
We may update, change or remove website features from time to time.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
To the extent permitted by law, we are not responsible for indirect or consequential loss arising from matters outside our reasonable control, including delays caused by third-party production providers, couriers, internet outages or other external events.
We are not responsible for errors in personalised content that:

were supplied by you;
-
were reasonably visible in the digital proof; and
-
were approved by you before printing.
This section does not limit any rights or remedies you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.
22. Consumer Guarantees
Nothing in these Terms is intended to exclude, restrict or modify your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand consumer protection legislation.
Products supplied to consumers must meet the guarantees required by law, including requirements relating to acceptable quality and matching their description. Where these guarantees are not met, you may be entitled to an appropriate remedy.
23. Privacy
Your privacy is important to us.
Our collection and use of personal information is governed by our Privacy Policy.
By using our website and providing personal information, you acknowledge that information will be handled in accordance with that policy.
24. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our business, products, website, service providers or legal obligations.
The current version will be published on our website and the “Last updated” date will show when it was most recently revised.
Changes will not retrospectively remove rights relating to orders already placed.
25. New Zealand Law
These Terms are governed by the laws of New Zealand.
Nothing in these Terms prevents you from exercising any rights you may have under applicable consumer law.
